Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential struck-by hazards associated with the structural failure of a crane's boom: (a)Derr & Gruenewald Construction Co. & 12401 E. 17th Ave, Denver, CO 80045: On or before September 19, 2006, the employer's designated person responsible for the crew involved in the off-loading of steel beams from a flatbed trailer, did not ensure that the information provided to the crane operator was accurate involving the actual weight of the steel beams. The foreman indicated to the crane operator that each beam weighed 1000 lbs, in which the beams actually weighed 2000 lbs per beam. This condition resulted in a load that exceeded the Manitowoc 4100 Series 1 with a No. 23 boom and No.124 jib lifting capacity and the eventual structural failure of the boom. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME B30.5-2000, The American Society of Mechanical Engineers-An American National Standard-Standard for Mobile and Locomotive Cranes-requirements associated with Section 5-3.2 Operating Practices: 5-3.2.1.1 Size of the Load (c)When loads that are not accurately known are to be lifted, the designated person responsible for the job shall ascertain that the weight of the load does not exceed the crane ratings at the maximum radius at which the load is handled, as per ASME B30.5-2000, The American Society of Mechanical Engineers- An American National Standard- Safety Standard for Mobile and Locomotive Cranes.
