Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards and caught in-between hazards: (a)Restruction Corporation & 1133 Race Street, Denver, CO 80206: On or before March 13, 2007, the employer did not ensure the Fraco single mast climber was dismantled according to manufacturer's recommended procedures associated with the ground base configuration and the removal of the last anchor while the platform was elevated. As a result of removing the final anchor attached to the structure, the mast climber became unstable and tipped over. The platform was a shored system that measured approximately 3'5" wide by 7 feet long. The condition exposed employees to hazards of falls approximately 15 to 20 feet. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter"). Among other methods, one feasible and acceptable abatement method can be found in Part IV Functioning of the FRACO system, of the ACT User's Guide rev. 8/2005. Section IV-9 through IV-10 identify procedures involving steps to remove the last anchor. In addition ANSI/SIA A92.9-1993 Section 7.10 During operation. The mast climbing work platform shall be used in accordance with this Standard and manufacturer's instructions.
