Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish a place of employment which was free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to caught-in-between hazards:
(a)Grand River Construction Co. & Cottonwood Drive, Basalt, CO 81621:
On or before June 6, 2007, the exposing employer did not ensure employees
operating the Ingersol-Rand DD-28HF roller/compactor were utilzing seat
belts. The employee operating equipment adjacent to vehicles moving through
the work-zone was exposed to struck-by hazards.
Abatement Note: Abatement certification is required for this item (see
enclosed "Sample
Abatement Certification Letter").
Among other methods, one feasible and acceptable abatement method can be
found in SAE
J153 Surface Vehicle Recommended Practice, Section 4.2 Operator-General
Precautions,
instructs operators: "Wear the seat belt to maximize the protection
capability
of a ROPS
(Roll Over Protective Structure) when the machine is so equipped."
