Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in-between hazards: (a)Colorado Eggs, LLC & 1133 21 Rd, Grand Junction, CO 81505: On or before June 5, 2007, an employee rode on a step of a John Deere 2430 while traveling in front of the barns. This condition exposed the employee to hazards of caught-in-between and struck-by hazards as a result of falling off the tractor. Among other methods, one feasible and acceptable abatement method to correct this hazard can be found in SAE J153, Surface Vehicle Recommended Practice, Section 4.3 Operator- General Precautions, instructs operators: "Do not permit riders on the machine if there are no manufacturer's designated place for a rider." Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
