Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to caught-between and struck-by hazards:
a)Angel Alvaz Construction & 2428 Champa Street in Denver, CO: The
employer did not ensure the operator was in position to control the rough
terrain forklift when the loaded platform was raised.  This condition
exposed
employees to caught-between and struck-by hazards.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to perform the following:
ASME B56.6-1992, American Society of Mechanical Engineers, Section
5.15.1(s) "A trained
operator shall be in position to control the rough terrain forklift truck
or available to operate
controls if the platform is not equipped with controls.  When the operator
is
not in the
operating position, block the truck wheels and apply the parking brake
with all travel
controls in neutral".

employer did not ensure rough terrain forklifts were inspected prior to
use and
removed from service when unsafe conditions existed such as but not limited
to severely damaged tires.  This condition exposed employees to caught-
between and struck-by hazards.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to perform the following:
ASME B56.6-1992, American Society of Mechanical Engineers, Section 6.5.1.1
"If the
rough terrain forklift truck is found to be in need of repair or in any
way unsafe, or if it
contributes to an unsafe condition, the matter shall be reported
immediately to the user's
designated authority, and the truck shall not be operated until it has
been restored to safe
operating condition".
