Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall of 15 feet while working from a platform held aloft by a rough terrain forklift without a nameplate with markings showing maximum elevation with load laterally centered: (a)Custom On-Site Builders at 827 Blondel, Fort Collins, CO 80524: The employer did not ensure the Gradall rough terrain forklift used to lift a platform for elevating personnel was marked to show the capacity of the truck with the attachment at maximum elevation with the load laterally centered. This condition exposed the employees to hazards of fall of approximately 15 feet. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is: In this case OSHA has incorporated by reference the "American National Standard for Powered Industrial Trucks, Part II, ANSI B56.1-1969". To ensure the safe use of this personnel platform, the selected paragraph from the ANSI document is provided to assist you. "If the rough terrain forklift truck is equipped with front end attachment(s), the user shall see that the truck is marked to identify the attachment(s), show the approximate weight of the truck and attachment combination and show the capacity of the truck with attachment(s) at maximum elevation with the load laterally centered." Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
