Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that the
employer did not meet the operator responsibility to operate the rough
terrain forklift safely:
(a)Double J Disposal at 20754 Austin Rd., Austin, CO 81410:  The employer,
did not ensure the forklift operator fully understood his responsibility to
operate the forklift safely in that the forklift operator had not
developed safe
working habits. This condition exposed the employees to a struck by hazard.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to perform the following:
Read and follow ASME B56.6-1992, The American Society of Mechanical
Engineers
- An American National Standard - Safety Standard for Rough Terrain
Forklift Trucks
paragraph Section 6.1 Operating Safety Rules and Practices. Paragraph
6.1.2 reads
"This equipment can be dangerous if not used properly.  The operator shall
develop
safe working habits and also be aware of hazardous conditions in order to
protect
himself, other personnel, the rough terrain forklift truck, and other
material."
Abatement Note:  Abatement certification and documentation are required
for this item (see
enclosed "Sample Abatement-Certification Letter").-Certification
