Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of its employees a place of employment which was free from
recognized
hazards that were causing or likely to cause death of serious physical
harm to employees in
that employees were exposed to a struck by hazard which could inflict
death or serious injury
while transferring granite slabs in the shop:
(a) Home Depot Home Services Bath Remodeling, 12650 E. 33rd Ave. #141,
Aurora, CO 80011: On or before 10/31/07, employees were exposed to struck
by
hazards while transferring granite/marble slabs in the shop. The
granite/marble slabs
are stored on "A" frames in the shop adjacent to the fabrication area.
When retrieving
the slabs, employees are required to separate the slab to be lifted from
the others in
order to attach the hoisting clamp attached to the forklift extension.
This activity
places the employees in the middle of the slab racking system in between
slabs. This
condition exposed employees to a struck by hazard with injuries including,
but not
limited to, broken bones, death.

Abatement-Certification Letter").
