Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that the malfunction of the high level switch on the
flammable liquid storage
tanks exposed employees to burn hazards:
(a) Conquest Disposal Service, Conquest-2 & 1191 WCR 19, Brighton,
CO 80601: On January 29, 2008, and at times prior thereto, the
employer did not maintain a place of employment which was free of
recognized hazards in that tank high level switches for tank numbers
201, 202, 203, and 204 were not maintained in proper working
condition. These switches were designed to automatically shut off the
pump to prevent tank overfilling.  Tank 203 was overfilled on January
29, 2008, due to its high level switch being inoperable. A fire occurred
as a result of the overfilling.
Abatement Note:  The National Fire Protection Association, NFPA30-2008,
under
Section 21.7- Operation of Storage Tanks. It states:
21.7.1 Prevention of Overfilling of Storage Tanks. Facilities with
aboveground
tanks larger that 1320 gal (5000 L) storing Class 1 or Class 11 liquids
shall
establish procedures or shall provide equipment, or both, to prevent
overfilling of
tanks.
21.7.1.1 Facilities with aboveground tanks that receive and transfer Class
1
liquids from mainline pipelines or marine vessels shall establish and
follow formal
written procedures to  prevent overfilling or tanks utilizing one of the
following
method of protection:
(1)Tanks shall b e gauged at intervals in accordance with established
procedures by
personnel continuously on the premises during product receipt. Acknowledged
communication shall be maintained with the supplier so flow can shut down
or
diverted in accordance with established procedures.
(2)Tanks shall be equipped with high-level detection device that is either
independent of any gauging equipment or incorporates a gauging and alarm
system that provides electronic self-checking to indicate when he gauging
and
alarm system has failed. Alarms shall be located where personnel who are on
duty throughout product transfer can arrange for flow stoppage or
diversion in
accordance with established procedures.
(3)Tanks shall be equipped with an independent high-level detection system
that will
automatically shut down or divert flow in accordance with established
procedures.
