North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)jobsite, for the B.R.S., Inc. employees who were struck-by a Lansas pneumatic plug while standing in the "Danger Zone" during plug inflation. Note: Manufacturer's safety instructions for the proper use of pneumatic pipe plugs include: 2. Always stay out of the "Danger Zone". 4.Ensure extension hoses and polylift rope/inflation lines are used to keep employees out of the "Danger Zone".
