Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a. On the site, the employer did not ensure the safety pallet used to lift personnel to the roof area was provided with a guardrail system. Among the feasible means of abatement that can be used to correct this are: Utilize only platforms designed for use in elevating personnel with forklifts. These must meet the requirement set forth in ANSI/ASME B56.6-2002, section 8.24.1(l), in that a restraining means such as a guradrail or a means for securing personnel such as a body belt or lanyard shall be provided.
