Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a. On the site, the employee was observed riding in the bucket of a Kobelco Trac Hoe in order to trim tree limbs. Among feasible means of abatement that can be used to correct this are: Providing a safe means of access to the tree limbs in order for the employee to cut them. This can be done through the use of a bucket truck or cherry picker designed for employees to ride in it and providing them with a means of fall protection anchorage points.ge
