Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the site where framing work was being accomplished, a worker was exposed to a fall hazard when he was being lowered while standing on the fork of a Skytrak Legacy 8042, SN# 610029, rough terrain forklift from the roof deck to the ground. Among the feasible means of abatement that can be used to correct this are: Utilize only platforms designed for elevating personnel with forklifts. Platforms must meet the requirement set forth in ANSI/ASME B56.6-2002.
