Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the following:
a.  On the site, the employer did not ensure the safety platform used to
lift prsonnel was not
more the 10 inches wide on each side of the load bearing wheel base and
that it was
equipped with an adequate guardrail system.
Among the feasible means of abatement that can be used to correct this are:
Utilize only platforms which meet the requirement set forth in ANSI/ASME
B56.6-2002,
section 8.24.1(b), in that the width of the platform shall not exceed ten
inches on either
side of the load bearing wheel base of the forklift and section 8.24.1(l),
the platform
shall be equipped with a guardrail that has a nominal height to the
platform
floor of 42
inches and include a midrail.
