Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the workplace, in the slow release area, the C & M Electric Chain Hoist used daily by employees to lift bins weighing 2700 pounds, had its last annual inspection in April 2006. Employees were exposed to a struck-by hazard. Among other methods, one feasible and acceptable method to correct this hazard was to have annual inspections conducted in accordance with ANSI B30.16-1981, Overhead Hoists (Underhung), Section 16-2.1.1, page 17.e

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the workplace, in the slow release area, the cone shaped lifting device developed by the employer, attached to the C & M Monorail Electric Chain Hoist by an orange shackle, had not been load tested before being used to lift bins of fertilizer mixture weighing approximately 2700 lbs., thus exposing employees to a struck-by hazard. Among other methods, one feasible and acceptable method to correct this hazard was to load test the lifting device in accordance with ASME B30.20-2003, "Below the Hook Lifting Devices", section 20-1.3.8.2 (a),page 15.,page

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while hoisting materials: a.In the slow release area, the employer had not labeled the cone shaped lifting device on the C & M Monorail Electric Chain Hoist, used daily to lift bins of fertilizer weighing approximately 2700 pounds, thus exposing employees to a struck-by hazard. b.In the slow release area, the employer had not labeled the orange shackle, connecting the cone shaped lifting device to the chain of the hoist of the C & M Monorail Electric Chain Hoist, used daily to lift bins of fertilizer weighing approximately 2700 pounds, thus exposing employees to a struck-by hazard. Among other methods, one feasible and acceptable method to correct this hazard is to affix data plates to the cone shaped lifting device and the orange shackle in accordance with ASME Standard B30.20 "Below the Hook Lifting Devices", section 20-1.2, page 12.

Among other methods, one feasible and acceptable method to correct this hazard was to have annual inspections of the lifting device in accordance with ASME B30.20-2003, "Below the Hook Lifting Devices", section 20-1.3.1(b)(3)(a), page 13.
