Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fall hazard and to the
hazard of being
caught/crushed by a moving elevator:
Location: 243 W 124th St, New York, N.Y.
On or about 12/14/06.
a)Freight elevator IF-4825 was not properly maintained. Among other
deficiencies the
hoistway door in the basement was hanging off its track and door and gate
interlocks
did not work. When the elevator was stuck between floors employees were
reaching
into the elevator with a pole to press the DOWN button to get the elevator
to go back
down to the basement. On 12/14/06 an employee was attempting to do this
when
the
elevator went UP unexpectedly, catching the employees' hands between the
elevator
and the doorsill.
b)Required elevator inspections were not being followed through to
completion,
including the latest one done 3/7/06, which remained incomplete because
needed
repairs were not completed.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
Comply with elevator inspection requirements of the NYC Elevator
Inspection program
including the 'Cease Use' notice issued 03/10/05.
Comply with ANSI A17.3-2002, Elevator Safety Standard;
Section 1.5, Periodic Inspections.
Section 2.6.1 and 3.4.1; which requires doors or gates at elevator
hoistway entrances and
inside the elevator car, and requires safety interlocks for all doors and
gates in order to
prevent the elevator from moving unless all doors and gates are closed.
Note:  The employer is required to submit abatement certification for this
item in accordance
with 29  CFR 1903.19.
