North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to throw against, struck by and crushed by Roll Over Protection System (ROPS) hazard during tipover: a)facility, Floor Department - where the seatbelt on the MASSEY FERGUSON 240 Tractor, Farm, Model 2402, S/N C04077 was frayed almost halfway through the width of the belt. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the damaged seat belt with a serviceable belt. References: SAE J333A, Operator Protection For Wheel Type Agriculture and Industrial Tractors; Paragraph 4.1; "In order to fulfill the intended purpose of this standard, tractors shall be equipped as follows:" Paragraph 4.1.2: "Seat belts conforming to SAE J4."
