North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to throw against, struck by and crushed by Roll Over Protection System (ROPS) hazard during tipover: a)planer mill - where the operator of a Hyster Model 165, forklift was not wearing the installed seat belts during operation. One feasible and acceptable abatement method to correct this hazard is to have operators fasten the installed seat belt when operating the equipment. (Reference: American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks (forklifts), ASME B56-1-1993, Paragraph 5.3.19: An active operator protection device or system, when provided, shall be used.
