North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from the homemade metal work platform used on the forklift: a)Job Site - A metal 19'11" long x 5'11" wide x 3'8" high, with three sides was being elevated with employees on the platform from the 5'11" end. The metal work platform was extending 17'11" beyond the center of gravity of the forks. Reference: ASME B56.6-1992, 8.25 Platforms for Elevating Personnel, 8.25.1(b) floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck name plate, measured parallel to the longitudinal center plane of the truck, nor have a width greater than the overall width of the truck (measured across the load bearing tires plus 10" (250mm) on either side). Minimum space for each person on the platform shall not be less than 18" (450mm) in either direction.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to working in a metal fabricated work platform that had no data plat plate to indicate its weight empty or the weight when personnel were on the platform: a)Job Site - Employees working from two metal work platforms that were being lifted by two JCB 532 rough terrain forklifts that did not have a data plate indicating empty weight and weight with employees on the platform Reference: ASME B56.6-1992, 8.25.1(f) information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform.;
