North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)At facility- in the pallet assemble line area, an employee was operating a power industrial truck, Clark, Model CMP25D, serial No. CMP230D-1908-9587, without using the safety seat belt. The power industrial trick was a straight mast type and was equipped with the seat belt. b)At facility- in the pallet assemble line area, an employee was operating a straight mast forklift, Toyota froklift truck, Model 7FDU25, serial No. 62348. Without using the safety seat belt. The forklift truck had the safety device available for the employee. One feasible and acceptable abatement method to correct this hazard is to have operators fasten the installed seatbelt when operating the equipment. (Reference; American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks (forklifts), ASME B56-1-1993, paragraph 5.3.19: An active operator protection device or system, when provided, shall be used.
