North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazards of being struck by and/or crushed by full or partial stacks of 12 - 16 foot long lumber being carried on a conveyor or by 8 - 10 feet overhead slings: a)site, outside, lumber stacker building, outfeed chain conveyor - where stacker employees and other employees worked in and/or traveled through the area of a hydraulically powered outfeed chain conveyor on a regular basis while accessing and/or egressing the overhead stacker area and/or traveling through the area of full, hydraulically driven stacks of 12 - 16 foot long lumber. b)site, outside, lumber sorter - where employees were working at approximately 8 - 10 feet below full or partial sling loads of 12 - 16 foot long lumber which was hydraulically driven when suspended overhead and not enclosed, guarded and/or barricaded to prevent personnel access and/or entry. Feasible and acceptable abatement methods, among others, to correct this hazard is to: 1) cease operation of the Hydra Stacker at all times that employees enter and/or access the immediate area in and/or around moving equipment, components and/or materials, 2) enclose by fencing, railing and/or barricade the immediate area in and/or around moving equipment, components and/or materials and beneath overhead moving sling loads to prevent and/or restrict personnel access and/or entry, Reference:Consolidated Sawmill Machinery International, Inc.
