NYSLL Article 2, Section 27-a.3.a(1):  The employer did not furnish to
each of it's
employees, employment and a place of employment which was free from
recognized hazards
that are causing or were likely to cause death or serious physical harm to
it's employees and
which will provide reasonable and adequate protection to the lives, safety
or health of it's
employees.  In applying this paragraph, fundamental distinctions between
private and public
employment have been recognized:
a)Sullivan County DPW employees were exposed to the hazard of being caught
under
vehicles or the lift structure, or being struck by a falling vehicle, in
the event of hydraulic
failure of the Gilbarco twin post vehicle lift, Model #A-3BM-51, while
servicing vehicles
located in the Berryville Shop.
Among other methods, one reasonable and adequate method to correct this
hazard is to equip
the lift with a mechanical device to hold the lift in all extended
positions as recommended by
the American National Standards Institute in the industry consensus
standard ANSI/ALB
153.1 "Safety Requirements for the Construction, Care and Use of
Automobile Lifts".  The
device should have a strength factor of not less than three (3), based on
the rated load
capacity of the lift.
