Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the potential for inhalation of ammonia:
Among other methods, feasible and acceptable methods to correct hazards
would include the
following:
1.Assure that information regarding the ammonia refrigeration system is
provided to
employees of U.S. Foodservice for example, standard operating procedures
containing
operating limits, consequences of deviation, steps to correct or avoid
deviation, personal
protective equipment availability, temporary operations, operations when
the computer
system fails or locks up in an unknown condition and adequate emergency
shutdown
procedures for abnormal or emergency conditions and all conditions in
which
shut down
is required and evacuation is necessary such as failure of components
(pipes,
compressors, vessels, evaporators) to contain ammonia, fire or other
critical safety
system failure such as compressor cutouts or exceeding safe operating
limits and also
identify who in those cases would be authorized and trained to shutdown
the system
(International Institute of Ammonia Refrigeration (IIAR) Bulletin 110,
Section 5.2.2);
2.Documentation of the amount of ammonia in the refrigeration system (IIAR
Bulletin 110
Section 5.6) and developing procedures for maintenance of that level
thereafter;
3.Retention of the manufacturer's information on the evaporator coil EC-18
that failed on
October 22, 2006 and an updated P & ID such as after the installation of a
new
condenser (installed on or about June 2004) (IIAR Bulletin 110 Section
4.0);
4.Assuring that recognized and accepted good engineering practices are
followed by
ensuring that:
King valves HV HCPR-01, HV HCPR-14 and HV HCPR-16 were labeled or
marked as King valves (IIAR Bulletin 109, Section 4.10.3);
King valves are accessible from the floor or a fixed platform (IIAR 2-1999
Section 6.0);
Self contained breathing apparatus (SCBA) are available outside the machine
room (IIAR Bulletin 109 Section 4.10.11 and ASHRAE 15-1994);
Written preventative maintenance procedures included manufacturer's
recommended practices and procedures for inspection and testing of piping
systems (ANSI/IIAR 2-1999 Section 6.2.2, IIAR Bulletin 110 Section 6.1 and
Section 6.7.1);
Weekly and other preventative maintenance checklists include a description
of the
inspection or test performed and the results of the inspections or tests
as on theEC-18 Evaporator (IIAR Bulletin 110 Section 4.0) and E-Stops for
shutdown
purposes are performed annually (IIAR 2-1999 Section 6.2.2);
Recommendations from the process hazard analysis conducted in 2003 are
addressed such as but not limited to mechanic's daily rounds, remote
access of
the computer system using a laptop computer and standard operating
procedures
to prevent hydrostatic pressure had not been implemented (IIAR 110 Section
5.2.1);
Corrections of deficiencies outside acceptable limits are made for
example, a
missing handle on the HV HCPR-14 valve that is listed as a King valve on
the
high pressure receiver (Bulletin 109 Section 4.10.3);
5.Assure that all contractor employees including PH & B employees are
trained on the
standard operating procedures and have the personal protective equipment
required by
the standard operating procedures (IIAR Bulletin 110 Section 5.2.3).
