Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of chemical burns to the skin and eyes:
(a)On or about March 8, 2007, in the event of a rupture of a 3,990
gallon stainless steel alloy storage tank containing a 50solution
of sodium hydroxide located in the rag room.
Feasible and useful abatement methods for reducing this hazard, include,
but are not limited to
the following: comply with the New York State Regulation Part 598 for the
Handling and
Storage of Hazardous Materials, that requires inspections of the storage
tank, alarms, gauges and
above ground piping at pre-determined frequencies.
