Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a)Jobsite - on or about July 20, 2007 - an employee was exposed to a fall hazard while engaged in the repair of a 30 inch storm sewer line. Employee was riding the bucket of the excavator track hoe in and out of the trench. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO FOLLOW THE MANUFACTURERS GUIDELINES SET FORTH IN THE OPERATING PROCEDURES MANUAL THAT STATES: NEVER ALLOW PERSONS TO RIDE ON THE MACHINE. SERIOUS INJURY OR DEATH CAN RESULT FROM ALLOWING PASSENGERS ON OR IN THE MACHINE.
