Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fire and burn hazards:
(a) Window/Screen assembly area- On or about September 9, 2006, the
employer provided the
Sampson Machine Co. cut off saw for cutting vinyl with a two position
motor start switch that
allowed current flow to the motor during electrical emergencies such as
power surges and under-
voltage conditions.
Among other methods, one feasible and acceptable method to correct this
hazard is to
include, but not be limited to the following:
Provide the saw with a magnetic restarter or equivalent device, as
prescribed in NFPA-79,
National Fire Protection Association, Electrical Standard for Industrial
Machinery,
Section 8.
In accordance with the requirements of 29 CFR 1903.19(d), abatement
certification is
required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION
WORKSHEET), and in addition, documentation demonstrating that abatement is
complete
must be included with your certification. This documentation may include,
but is not
limited to, evidence of the purchase or repair of the equipment,
photographic or video
evidence of abatement, or other written records.
