Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that. a) On or about 10/05/06, employees were exposed to impalement hazard from ground anchorage stakes for the braces used to secure the ULMA post shores. One feasible and acceptable method to correct this hazard is to develop and implement a policy limiting the time the exposed end of the stake is unprotected or presents an impalement hazard to employees. Such program shall require either immediate removal of protective devices prior to removal of stakes or sequential removal of protective devices as the work progresses.
