Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Bale Press Operator: The Bale Press Operator was exposed to continuous noise levels at 90.7of the allowable 8-hour time weighted average sound pressure level of 85dBA. The equivalent of 90.7is approximately 89.2dBA. The survey was conducted for 7 hours 37 minutes on 30 January 2007. Gila River Farms Gin has not enrolled this employee into a hearing conservation program. b)Gin Crew: A Gin Crew employee was exposed to continuous noise levels at 97.1% of the allowable 8- hour time weighted average sound pressure level of 85dBA. The equivalent of 97.1is approximately 89.9dBA. The survey was conducted for 7 hours 49 minutes on 30 January 2007. Gila River Farms Gin has not enrolled this employee into a hearing conservation program.
