Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by, crushed by and falling: a) Site: Employees are not protected from the hazard of being struck by loader machine. Violation observed on or about 1/3/2007. Violation observed again on 4/6/2007. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1) Develop and enforce a written standard operating procedure and train all the employees. 2) Install mirrors strategically installed to allow the loader operator to be able to view the area where the employees are working from inside the loader body from different angles. 3) Install warning devices on the top of the loader which warn operators of the loaders that a person is in within close proximity to the body of the loader. 4) Enforce the work rule of a buddy system (Co-worker to signal the loader operator that it is safe to dump the load).
