Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in hazards while attempting to clean the underside of the overhead conveyor. a) Sorting plant conveyor system. Employees working underneath the conveyor doing clean up & maintenance work were exposed the hazard of being caught in an in-running nip point and the moving belt and not having acess to an immediate emergency stop in accordance with ASME/ANSI B20.1-2003, Safety Standards For Conveyors And Related Equipment, section 5.2 (c): No maintenance or service shall be performed when a conveyor is in operation except as provided in paras 5.2 & 5.3. and 5.11.2 (c) Emergency stops shall be immediately available. Among other methods feasible means of abatement is to install a trip wire on both sides of the sorting conveyor and to prohibit cleaning under the belts when the conveyor is running. Violation occurred on or about 12/26/06.
