North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Facility, Maintenance - The crane system was not load tested prior to initial use. REF:ANSI B30.11-1998, Chapter 11-2, Paragraph 11-2.2.2 (a) New, reinstalled, altered, repaired and modified equipment should be load tested prior to initial use as determined by a qualified person. (b) If a load test is conducted, the load shall not be less than 100of the rated load of the equipment or more than 125of the rated load of the equipment, unless otherwise recommended by the manufacturer. (c) If a load test is conducted, the person conducting the load test shall prepare a written report of the load sustained during the test and the operations performed during the test. Reports shall be placed on file. NOTE: Among other methods, one feasible acceptable abatement method to correct this hazard is to conduct load testing of the crane system per the requirements of section 2.2.2 of ANSI B30-11-1998.

North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Facility, Maintenance - The rail of the Dayton 2 Ton Underhung Crane did not contain a posted rated load. Reference: ANSI B30.11-1998, Chapter 11-1, Section 11-1.1 Markings, Paragraph 11-1.1.1 Rated Load Markings - Crane. The rated load of the crane shall be marked on the crane and if the crane has more than one hoisting unit, each hoist shall have its rated load marked on the hoist or it load block so that the rated load marking shall be legible from the ground or floor. The combined load on all hoists on the crane shall not exceed the rated load of the crane. NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to properly mark the rated load on the components of the system.

Reference:ANSI B30.16-2003, Chapter 16-2, Section 16-2.1 Inspection, Paragraph 126-2.1.1 Inspection Classification. (a)Prior to initial use, all new, altered, modified hoists shall be inspected by a designated person to ensure compliance with this standard. (b)Inspection Intervals. Inspection procedures for hoists in regular service is divided into two general classifications based upon the intervals at which inspections should be performed. (1)Frequent Inspection (2)Periodic Inspection NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to conduct hoist inspections as required.
