North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)attic area above library, for the employees accessing the air conditioning units to change filters or perform routine or corrective maintenance, protection from falling between the trusses was not provided, exposing employees to a 12 foot fall hazard. On or about 12:07 PM, 11/01/06, while using ceiling joists as a walking surface to access air conditioning units in the attic, an employee fell between two joists approximately 12 feet to the carpeted concrete floor below. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to install an appropriate walking surface covering the open space between the joists, and an appropriate railing system to prevent falls through uncovered openings.
