North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to a risk of fire or explosion
in that:
a) within the facility, manufacturing area, employees were exposed to an
accumulation of explosive dust from approximately 1/2 inches on horizontal
surfaces to include piping and beams to 3 inches on equipment such as
sanders.
NOTE:  Among other methods, the feasible and acceptable method to abate the
hazard is to adhere to requirements in NFPA 484, Standard for Combustible
Metals, 2006 Edition, relating to minimization of the occurrence of and
resulting
damage from fire or explosion in areas where combustible metal dusts are
produced.  Elements of NFPA 484, Chapter 13 - Fire Prevention, Fire
Protection, and Emergency Response include the following:
(1) Fire and explosion protection and prevention equipment in
accordance with the applicable NFPA codes and standards;
(2)Dust control equipment;
(3)Housekeeping;
(4)Potential ignition sources;
(5) Electrical, process, and mechanical equipment, including process
interlocks;
(6)Process changes;
(7)Continuity check on grounding and bonding systems;  and
(8) Resistivity testing of static dissipative footwear and conductive
floors where required.

serious physical harm
to employees in that employees were exposed to struck-by or caught
in-between hazards:
a) within the facility, manufacturing area, six Dayton chain hoists were
being used
to suspend swing machines weighing 150 - 300 pounds and had not been
inspected since 1999.

Inspection, Testing and Maintenance.
NOTE:  Among other methods, the feasible and accpetable method to abate the
hazard is to assure the Dayton chain hoists are frequently inspected as
required
by the ANSI B30.16-1981 for "severe service".
