Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The
employer did not
furnish employment and a place of employment  which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that, employees
were exposed to falls from moving vehicles:
a) On or about May 7, 2007 and at times prior, employees were exposed to
injury while
placing traffic cones on highway 160, employees were not restrained from
falling from the
platform on the side and back of moving vehicles.
Among other methods, one feasible and acceptable abatement method to
correct this
hazardous condition would be: 1) To install an anchorage point on the side
and back of the
vehicles for connection of a restraint system consisting of a full body
harness and lanyard. 2)
Or install standard guardrail system on the platform where employees stand
to place and
remove the traffic cones or other traffic control devices. 3) Utilize an
automatic
safety device
placement and retrieval equipment.
