Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion hazards: a) On or about May 16, 2007 and at times prior, Superior Well Service Inc. did not ensure that employees were protected from explosion hazards. The truck bed used to transport the explosives was not spark proof and a can of gas was transported in the bed with the explosives. Among other methods, one feasible and acceptable abatement method is to follow the standards of the industry listed in Colorado State Division of Oil and Public Safety sections 5.1(B)(6) and 5.1(B)(8).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion and fire hazards: a) On or about May 16, 2007 and at times prior, Superior Well Service Inc. did not ensure that employees were protected from explosion and fire hazards. The vehicle used to transport explosives did not have filled and proper working order extinguishers. Among other methods one feasible and acceptable abatement method to correct this hazardous condition would be to develop and implement procedures to inspect and replace inoperable extinguishers. The Colorado State Division of Oil and Public Safety Explosive Regulations chapter V are an example of the inspection and extinguisher requirements that should be followed. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosions: a) On or about May 16, 2007 and at times prior, Superior Well Service Inc. did not ensure that employees were protected from explosions. Electrical storms were in the area where explosives were being loaded. Among other methods one feasible and acceptable abatement method to correct this hazardous condition would be to suspend all blasting operations in accordance with the Explosives Regulations of The Colorado State Division of Oil and Public Safety, Section 6.1(H). A useful tool to use when determining to shut down a blasting operation would be a storm and lightning detector.
