Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to falls while standing on a platform where the upright support (leg) was damaged (bent). a) On or about July 3, 2007, the employer did not ensure that employees were protected from fall hazards while working from the #1 palletizer platform where the upright support was damaged (bent leg). Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to inspect and repair all elevated walkways on a regular bases, and to retrain all forklift operators to immediately report all incidents where upright supports are contacted. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were allowed to use pallets to access semi-trailers (storage) which exposed employees to falls to falls from heights that could cause serious injuries: a) On or about July 3, 2007, the employer did not ensure that employees were protected from fall hazards while using pallets as ladders while accessing semi-trailers to retrieve materials. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition is to provide rolling stairs with handrails and/or ladders which conform in accordance with ANSI-A14.1, 1982, Section 5.1.1.1. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
