Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment or a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)On or about July 23, 2007, and at times prior, employees at the concrete plant were exposed to fall hazards where the manlift used to transport employees from the upper area near the operator station to the ground level and vice-versa was not used in accordance with the manufacturer's guidelines. Employees were stepping out of the basket to access the upper level which was approximately 30 feet above the ground. The operator manual for this model of lift states that operators should remain on the platform when the lift is in the raised position. Among other methods, one feasible and acceptable method to correct this hazard is to use a manlift or elevator that is designed for this purpose. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
