Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, an employee was exposed to crushing hazards while riding on rear-loading refuse collections vehicle: a) On or about August 6, 2007 an employee was exposed to crushing hazards while riding on the cab access steps (drivers side) while the truck was moving in the reverse direction. Among other methods, a feasible and acceptable method to correct this hazardous condition would be to implement a program which complies with ANSI Z245.1-1999, specifically; monitoring employees and taking appropriate corrective actions to ensure that employees comply with safe work practices, (Section 6.1.4.1), ensuring employees only ride in the cab or on the riding step, (Section 6.2.3.2(b)), and ensuring no employee rides on any step while the vehicle is operated in the reverse direction, (Section 6.2.3.2(c)). Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
