Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to falling products while loading and unloading products from storage racks which were damaged (bent). a) On or about August 13, 2007, the employer did not ensure that employees were protected from falling material while loading and unloading products from storage racks that had bent supports. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to establish an inspection and repair program in accordance with the manufactures recommendation, and to encourage forklift operators to report all incidents where racks are damaged. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
