Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The
employer did not
furnish employment and a place of employment which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that, employees
were exposed to the crushing hazards while operating a Michigan Clark 55B
Front End
Loader that was not properly maintained:
a) On or about September 13, 2007 employees were exposed to injury while
operating a
Michigan Clark 55B, Front End Loader that had the following deficiencies:
1)Service brakes and parking brake were not functional.
2)There was a missing connector pin on the bucket.
3)The unit had multiple hydraulic leaks.
4)Missing windshield wipers.
5)No back up alarm.
6)No seat belt.
Among other methods, a feasible and acceptable method to correct this
hazardous condition
would be to develop and implement a preventive maintenance program in
accordance with
manufacture recommendations which would include regular and periodic
inspections.
