Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free feom recognized hazards that were causing or likely to cause death or serious phisical harm to employees in that, employees were exposed to the hazards of being crushed by unstable marble slabs during slab loading, unloading, storing, and transporting operations: a) On or about October 23, 2007, at 2155 W. Bates, Englewood, CO the employer did not ensure that proper slab handling techniques were used to protect employees from crushing hazards while loading the stone slabs. The employees are required to hold on to the slab which weigh approximately 600-800 pounds (by hand) while the clamp is released from the stone slab and the employees required to secure the slabs to the A- frame with a synthetic strap while standing in the danger zone on the bed of a pick-up. The ground in the loading zone area was not level. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: a) Institute and enforce a policy in which employees are prohibited from standing or putting any portion of their body in the danger zone of the unsecured slabs. b) Ensure the loading area is level where the slabs are loaded onto an A-frame on a pick-up or trailer at a safe angle and to make sure the slabs do not shift. c) Conduct employee training on the safe handling of stone slabs. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
