Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The
employer did not
furnish employment and a place of employment  which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees, in
that:
a) On or about November 8, 2007 and times prior, employees of 7-Eleven
store #20638 were
exposed to injuries resulting from physical assaults.  The employer had
not developed and
implemented adequate measures to protect employees from assaults or other
forms of
physical violence in the workplace.  This hazard is recognized by the
employer and by the
industry.
Feasible methods to protect employees from the hazard of physical assault
may include, but
are not limited to, the following:
1. Maintain and use silent personal alarms which is recognized by NIOSH as
a viable
workplace violence control measure.
2. Develop and train employees to follow emergency procedures, to include;
A) Conflict resolution training.
B) Nonviolent response training.
C) Robbery deterrence training.
3. Use of physical barriers with bullet proof enclosures and pass-through
windows.
4. Increased staffing to ensure that employees are not working alone.
5. Closing the establishment during high-risk hours (late night and early
morning).
6. Once the coordinated plan is implemented, maintain communication with
local law
enforcement and employees, as well as regular surveillance of working
conditions, to review
and evaluate the measures taken to prevent assaults.
