Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to structural collapse of the drilling rig: a. On or about January 9, 2008, and at times prior, Eagle Well Service dba Bronco Energy Services, Inc. did not ensure that employees were protected from crushing hazards due to structural collapse. The lower derrick locking pins were not secured (Bronco Rig #33). Abatement Note: Among other methods one feasible and acceptable abatement method to correct the hazardous condition is to adhere to Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, API 54, Third Edition, August 1999, Reaffirmed, March 2007, Section 9.2.8, which states: Bolts, nuts, and pins on elevators, wire rope, and catlines, as well as sheave and other anchor bolts in the derrick or mast should be secured. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards from grasping a fast moving wire rope: a. On or about January 9, 2008, an employee was exposed to hazards from "burning" the wire rope while tripping pipe. The employee was placing his hand on the wire rope while it was moving in order to the move the traveling block closer to the racking board. Among other methods one feasible and acceptable abatement method to correct this hazardous condition would be to train employees on the hazards of handling fast moving wire rope and ensure this practice is discontinued. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards from improperly secured guy line wires: Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to adhere to the American Petroleum Institute Recommended Practice on Application Care, and use of Wire Rope for Oil Field Service 9B Twelfth Edition, June 2005, Section 3.7.4.2, which states, in part: When two clips are required, apply the second clip as near the loop or thimble as possible. b. On or about January 9, 2008, employees were exposed to crushing hazards from improper spacing on the derrick guy wire clamps. The wire rope clips were spaced un-evenly between the first and last connection on the dead end of the guy wire rope. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to adhere to the American Petroleum Institute Recommended Practice on Application Care, and use of Wire Rope for Oil Field Service 9B Twelfth Edition, June 2005, Section 3.7.4.3, which states, in part: Space additional clips equally between the first two. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
