Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards: (a) JOBSITE AT MCDONALD'S RESTAURANT, 809 BOSTON RD., SPRINGFIELD, MA -- ON OR ABOUT 12/5/2007, TWO (2) EMPLOYEE(S) WERE EXPOSED TO A FALL HAZARD WHILE WORKING UP TO 20' IN HEIGHT FROM A PLYWOOD PLATFORM SECURED TO A WOODEN PALLET WHICH WAS ATTACHED TO THE FORKS OF A TEREX ROUGH TERRAIN FORKLIFT TRUCK, EXPOSING SAID EMPLOYEE(S) TO POSSIBLE FRACTURES, MULTIPLE INTERNAL INJURIES, AND/OR DEATH IN THE EVENT OF A FALL. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO USE ELEVATED WORK PLATFORMS ON ROUGH TERRAIN FORKLIFT TRUCKS AS DESIGNED BY THE MANUFACTURER WHICH MUST MEET THE DESIGN, CONSTRUCTION, AND USE REQUIREMENTS AS OUTLINED BY THE AMERICAN NATIONAL STANDARD INSTITUTE, ASME/ANSI B56.6-2005, SAFETY STANDARDS FOR ROUGH TERRAIN FORKLIFT TRUCKS, SECTION 5.15.1, REQUIRES THAT IF A ROUGH TERRAIN FORKLIFT TRUCK MUST BE USED TO LIFT PEOPLE, THE FOLLOWING PRECAUTIONS MUST BE TAKEN FOR THE PROTECTION OF PERSONNEL: PARAGRAPH (a) PROVIDE A PERSONNEL PLATFORM WHICH COMPLIES WITH THE DESIGN REQUIREMENTS LISTED IN PART III OF THIS STANDARD, AND PARAGRAPH (b) BE CERTAIN THAT THE PLATFORM IS SECURELY ATTACHED TO THE LIFTING CARRIAGE AND FORKS, AND PARAGRAPH (k) BE CERTAIN THAT THE REQUIRED RESTRAINING DEVICE(S) BE PROVIDED FOR EMPLOYEE SAFETY.
