Section 5(a)(1) of the Occupational Safety and Health Act of l970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to a falling hazard by climbing on and over the midrail and top rail of an aerial platform to access a building ledge while hanging holiday decorations. Among other methods, feasible and acceptable methods of abatement would be: 1. To comply with American National Standards ANSI/SIA A92.6-2006, paragraph 8.10(9) which states: "personnel shall maintain firm footing on the platform floor while working. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited." 1 MONARCH PLACE, SPRINGFIELD, MA: AN EMPLOYEE CLIMBED OVER THE TOPRAIL AND MIDRAIL OF A JLG LIFT TO ACCESS A BUILDING LEDGE TO HANG HOLIDAY DECORATIONS.
