Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees operating the Ford 45A Loader were exposed to crushing injuries posed by the loaders tires, equipment framework or the rollover protective structure (ROP) during operation, collision and or rollover of the Loader during snow removal activities. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO REPLACE THE MISSING SEATBELT AND MANDATE THAT ALL OPERATORS OF THIS AND SIMILAR EQUIPMENT UTILIZE THE PROVIDED SEATBELTS AND IMPLEMENT A TRAINING AND ENFORCEMENT PROGRAM CONCERNING THE USE OF SEAT BELTS.
