Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to fall hazards: Jobsite: Employees were using a material hoist that was not rated for climbing to access the roof approx 29' above the ground. Among others, one feasible and acceptable means of abatement is to follow the safety and usage instructions specified by the hoist manufacturer and to use another ladder to safely access the roof.
