North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to 1-Bromopropane: a)gluing/spraying area, employees working in the gluing/spraying area used spray guns to apply whisper spray adhesive to foam pieces to make furniture cushions; the adhesive contained 50- 601-Bromopropane which is known to effect the central nervous system, reproductive system, and respiratory system. Air monitoring results revealed employee exposures as follows: 1. On November 29, 2006, employee A was exposed to 1-Bromopropane levels at an 8- hour time-weighted average of 104.49 ppm. This exposure level was derived from six samples collected over 339 minutes, with zero exposure assumed for the unsampled time period. 2. On November 29, 2006, employee B was exposed to 1-Bromopropane levels at an 8- hour time-weighted average of 78.73 ppm. This exposure level was derived from six samples collected over 349 minutes, with zero exposure assumed for the unsampled time period. NOTE:Among other methods, one feasible and acceptable method to abate this hazard is to provide an effective ventilation system that would reduce the exposure level to below 10 ppm, as the recommended exposure limit listed by Great Lakes and the ACGIH, as indicated on the Imperial Adhesives, Inc., MSDS which was provided to NCDOL by Carolina Foam, LLC and the Henkel Corporation MSDS provided through the manufacturer. Or in the Alternative: 29 CFR 1910.94(c)(5)(i): Ventilation for spray finishing operation(s) was not provided in accordance with the provisions of Section 1910.107(d) or in accordance with the requirements of this subparagraph: a)gluing/spraying area, employees working in the gluing/spraying area used spray guns to apply whisper spray adhesive to foam pieces to make furniture cushions; the adhesive contained 50- 601-Bromopropane which is known to effectthe central nervous system, reproductive system, and respiratory system.
