Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from riding on an unapproved platform. Among other methods, one feasible and acceptable method to correct this hazard is:....... Use an approved platform designed by Gradall Manufacturer in accordance with All-Terrain Forklift operations manual. a.On or about March 9, 2007, at the job site on the south end of the building, the JLG G6-42A All-Terrain Fork Lift was not being used in accordance with Gradall manufacturers operation manual to lift personnel, employees were exposed to fall hazards.
