Section 5 (a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees, in that, employees were
exposed to potential
rollover hazards and crushing injuries while operating a vibratory asphalt
compactor roller
without the ROPS.
Location - Boston Golf Club; Old County Road, Hingham:
0n 05/21/07 and 05/23/07, employees were exposed to rollover hazards while
operating
the Ingersoll-Rand DD-24 without the ROPS.
The method or methods to feasibly correct or abate the hazards include,
but are not
limited to, the following elements:
1. Ensure that the operator performs a worksite inspection to assess
possible hazards such
as sloped, inclined or unstable surfaces that may subject the compactor to
rollover
hazards.
2. Ensure that all operators use the equipment with the ROPS and seatbelt
installed on
the compactor when operating on road construction sites.
3. Ensure that all operators follow manufacturers' danger warnings
outlined in the
manufacturers' safety manual and are familiar with the operations and
maintenance
manual prior to operating the equipment.
